Terms & Conditions

These General Terms and Conditions (GTC) govern the contractual relationship between SwissPeak Partners GmbH, Sinserstrasse 67, 6330 Cham, CHE‑411.117.418 (SwissPeak Partners) and, on the one hand, business clients receiving HR consulting and placement services (B2B Recruitment & HR Consulting) and, on the other hand, private clients purchasing paid career consulting packages for the Swiss job market (B2C Career Consulting). Any terms and conditions of the client deviating from or conflicting with these GTC shall only apply if SwissPeak Partners has expressly agreed to them in writing.

SwissPeak Partners provides consulting services in the area of human resources, in particular supporting end‑to‑end hiring processes, workforce planning, nearshoring concepts and the placement of candidates for permanent positions with companies in Switzerland. The specific scope of services, such as search mandates or consulting projects, is defined in individual mandate agreements, offers, statements of work or order confirmations; in case of conflict, such specific agreements prevail over these GTC.

SwissPeak Partners also offers, separately from its recruitment services, paid career consulting packages for the Swiss job market (such as Essential, Premium or Executive), which may include individual consulting sessions, CV optimisation or creation, interview preparation, Swiss salary benchmarking, LinkedIn profile recommendations and strategic career advice. These career consulting packages are directed at private individuals and do not constitute recruitment or placement services; no entitlement exists to job offers, employment or any specific hiring outcome.

B2B mandates are concluded when the client accepts a written offer, mandate agreement or order confirmation issued by SwissPeak Partners, including acceptance by e‑mail. B2C career consulting packages are booked online via the booking and payment functions provided on the website, for example via Stripe payment links; the contract is concluded upon successful payment and confirmation by e‑mail, after which the appointment is scheduled.

For B2B mandates, the fees, such as success‑based placement fees, retainers, hourly or daily rates, are defined in the respective mandate agreement or offer, plus statutory VAT where applicable. Expenses and travel costs are invoiced as agreed or according to actual costs. Career consulting packages must be paid in advance online; without successful payment, the client has no entitlement to the service. As a rule, payments are non‑refundable once the booking is confirmed, unless SwissPeak Partners cancels the session or a re‑scheduling is mutually agreed.

B2B clients shall provide SwissPeak Partners with all information necessary for the performance of the mandate in a complete and accurate manner, including job descriptions, framework conditions and information on decision‑making processes, and shall make decisions in a timely fashion. B2C clients shall provide correct and complete information regarding their background, qualifications and goals and shall treat the documents provided by SwissPeak Partners as confidential; any commercial use or distribution of consulting materials or templates to third parties is prohibited without prior written consent.

SwissPeak Partners performs all services with due care but does not guarantee a particular result, neither in the B2B nor in the B2C area, in particular not the hiring of a specific candidate or the employment of the advised individual. To the extent permitted by mandatory Swiss law, any liability of SwissPeak Partners for slight and ordinary negligence is excluded; liability for gross negligence and unlawful intent, as well as for personal injury, cannot be excluded in advance under Swiss law.

SwissPeak Partners treats all information received in connection with mandates and consulting sessions as confidential and uses it solely for the purpose of providing the agreed services, subject to legal disclosure obligations. The processing of personal data is additionally governed by the Privacy Policy published on the website; in case of discrepancies, the provisions of the Privacy Policy prevail over these GTC with regard to data protection matters.

All analyses, reports, concepts and other work results created by SwissPeak Partners in B2B mandates, as well as all documents produced or revised within career consulting, including CV layouts, text modules and presentations, remain the intellectual property of SwissPeak Partners unless expressly agreed otherwise in writing. The client receives a non‑exclusive, non‑transferable right to use such materials for internal purposes in the case of B2B clients or for personal purposes in the case of B2C clients; any further use, in particular commercial distribution to third parties, requires the prior written consent of SwissPeak Partners.

All contractual relationships with SwissPeak Partners are subject exclusively to Swiss substantive law, excluding its conflict‑of‑laws rules and international conventions, in particular the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising out of or in connection with these GTC and the underlying contracts is Cham, Canton of Zug, Switzerland, subject to any mandatory statutory places of jurisdictio
