Terms and Conditions
These General Terms and Conditions govern the contractual relationship between SwissPeak Partners GmbH, Sinserstrasse 67, 6330 Cham, Switzerland, CHE-411.117.418, and business clients receiving recruitment or HR consulting services, as well as private clients purchasing paid career consulting packages for the Swiss job market. Any client terms that conflict with these General Terms and Conditions only apply if SwissPeak Partners has expressly accepted them in writing.
SwissPeak Partners provides services in the field of human resources and recruitment, including end-to-end hiring support, workforce planning, nearshoring concepts and the placement of candidates for permanent positions with companies in Switzerland. The exact scope of services is defined in the relevant offer, mandate agreement, statement of work or order confirmation. If there is any conflict, the individual agreement takes precedence over these General Terms and Conditions.
SwissPeak Partners also offers paid career consulting packages for private individuals, such as Essential, Premium or Executive packages. These may include consulting sessions, CV optimisation or creation, interview preparation, Swiss salary benchmarking, LinkedIn profile recommendations and strategic career advice. These services are advisory only and do not guarantee employment, job offers or any specific hiring result.
B2B mandates are concluded when the client accepts a written offer, mandate agreement or order confirmation issued by SwissPeak Partners, including acceptance by e-mail. B2C career consulting packages are booked online through the website or other booking and payment functions, for example via Stripe payment links. The contract is concluded once payment has been successfully received and the booking has been confirmed by e-mail.
For B2B mandates, fees such as success-based placement fees, retainers, hourly or daily rates are determined in the individual agreement or offer, plus statutory VAT where applicable. Expenses and travel costs are charged as agreed or according to actual cost. Career consulting packages must be paid in advance online. Without successful payment, there is no entitlement to the service. As a rule, payments are non-refundable once the booking has been confirmed, unless SwissPeak Partners cancels the session or a rescheduling is mutually agreed.
B2B clients must provide all information needed to perform the mandate in a complete and accurate manner, including job descriptions, framework conditions and information on decision-making processes, and must make decisions in a timely way. B2C clients must provide correct and complete information about their background, qualifications and goals and must treat documents provided by SwissPeak Partners as confidential. Any commercial use or distribution of consulting materials or templates to third parties is prohibited without prior written consent.
SwissPeak Partners performs all services with due care but does not guarantee any particular result, whether in B2B or B2C matters. In particular, no guarantee is given for the hiring of a specific candidate or the employment of the advised individual. To the extent permitted by mandatory Swiss law, liability for slight and ordinary negligence is excluded. Liability for gross negligence, unlawful intent and personal injury cannot be excluded in advance under Swiss law.
SwissPeak Partners treats all information received in connection with mandates and consulting sessions as confidential and uses it only for the agreed services, subject to legal disclosure obligations. Personal data processing is governed additionally by the Privacy Policy published on the website. In case of discrepancies, the Privacy Policy prevails with respect to data protection matters.
All analyses, reports, concepts and other work results created by SwissPeak Partners in B2B mandates, as well as all documents produced or revised within career consulting, including CV layouts, text modules and presentations, remain the intellectual property of SwissPeak Partners unless expressly agreed otherwise in writing. The client receives a non-exclusive, non-transferable right to use such materials for internal purposes in the case of B2B clients or for personal purposes in the case of B2C clients. Any further use, especially commercial distribution to third parties, requires prior written consent.
SwissPeak Partners uses a website that may include job listings, contact forms and other content. Job listings and application processes may be provided through third-party systems or integrations, including applicant tracking systems and external job platforms such as LinkedIn. SwissPeak Partners does not guarantee uninterrupted availability of the website or third-party systems. Additional terms and privacy notices of those third-party providers may apply.
All contractual relationships with SwissPeak Partners are subject exclusively to Swiss substantive law, excluding conflict-of-laws rules and international conventions, in particular the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising out of or in connection with these General Terms and Conditions and the underlying contracts is Cham, Canton of Zug, Switzerland, subject to mandatory statutory places of jurisdiction.
